Remedy Drinks Pty LTD (ACN 609 783 066) and each of its owned subsidiaries (collectively, Remedy, we us or our) is committed to providing quality services to you and this policy outlines our ongoing obligations to you in respect of how we manage your Personal Information. We have adopted the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth). The NPPs govern the way in which we collect, use, disclose, store, secure and dispose of your Personal Information of individuals who acquire products from us or otherwise use our services. 

This policy outlines our ongoing obligations to you in respect of how we manage your Personal Information in compliance with the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth) (Privacy Act). The APPs govern the way in which we collect, use, disclose, store, secure and dispose of your Personal Information (as defined below). What type of personal information do we collect?

The types of Personal Information that we collect from you depend on the types of dealings you have with us and may include, but is not limited to, any or all of the following information about you:

Sensitive information is defined in the Privacy Act to include information or opinion about such things as an individual's racial or ethnic origin, political opinions, membership of a political association, religious or philosophical beliefs, membership of a trade union or other professional body, criminal record or health information.  We do not generally collect sensitive information about you, however may do so  if you provide us with certain services, for example as a contractor or consultant, in which case we may need to collect certain sensitive information (including health information and information about your criminal history and record) including while carrying out safety inductions, where we require you to provide driving records or medical certificates and in conducting criminal record checks). We will only collect sensitive information with your prior consent.

How do we collect your personal information?

We primarily collect Personal Information directly from you when you when you use our websites to place orders for our products, or access or use our services, including when you set up a user account with us. We may also collect personal information from you when you have other dealings with us, for example if you participate in any user surveys, correspond or engage with us (whether by telephone, facsimile, email, mail or via social media channels), including where you send us any complaints or queries about our products and services or otherwise provide us with feedback.

We also collect information automatically through your use of  our website and services. This includes your computer’s internet protocol (IP) address [and information we receive from devices you use when you use our websites or access or use our services, including from third party providers such as Google Analytics.]  We use cookies, web beacons, unique identifiers and similar technologies to collect information regarding your interaction with our websites. When you use our websites and/or our services, or order products from us, details may be recorded about [your use and usage history]. 

We may also collect your personal information from third parties if you have consented to this.

Why do we need your personal information?

When we collect Personal Information we will, where appropriate and where possible, explain to you why we are collecting the information and how we plan to use it, or this will otherwise be obvious when we collect the information.

Direct Marketing
Where we have your express or implied consent, or where we are otherwise permitted by law, we may use your personal information to send you information about promotions, products or services we offer, as well as other information.  We may send this information by mail, email, SMS and telephone or via an in-app notification. If you no longer wish to receive these communications, you may opt out at any time by using the unsubscribe facility that we use in our messages. You may also unsubscribe from our mailing/marketing lists at any time by contacting us in writing. 

Public Information
Any information posted by you on review forums or communicated in chat areas becomes public information and we therefore cannot guarantee the security of this information.  We are not responsible for personal information (or other information) you chose to submit in such forums.

Using other sites

In general, the third-party providers we use will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide to us.

However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the information we are required to provide to them for your purchase-related transactions.

For these providers, we recommend that you read their privacy policies so you can understand the manner in which your personal information will be handled by these providers.

In particular, remember that certain providers may be located in or have facilities that are located in a different jurisdiction than either you or us. When you click on links on our store, they may direct you away from our site. We are not responsible for the privacy practices of other sites and encourage you to read their privacy statements. Shopify
Our store is hosted by Shopify. They provide us with the online e-commerce platform that allows us to sell our products and services to you. Your data is stored through Shopify’s data storage, databases and the general Shopify application. They store your data on a secure server behind a firewall.

Payment gateway
If you choose a direct payment gateway to complete your purchase, then our payment gateway provider Eway stores your credit card data. It is then encrypted via TLS 1.2 standards. Your purchase transaction data is stored only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted.

All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

How do we store and protect your personal information?

The security of your personal information is important to us and we take reasonable precautions and follow industry best practices to keep your Personal Information secure and protect it against loss, misuse, unauthorised access, modification or disclosure.

If you provide us with your credit card information, the information is encrypted using secure socket layer technology (SSL) and stored with a AES-256 encryption.  Although no method of transmission over the Internet or electronic storage is 100% secure, we follow all PCI-DSS requirements and implement additional generally accepted industry standards.

If we are involved in a merger, acquisition, asset sale or change in control, we will use our reasonable endeavours to continue to ensure the confidentiality of any personal information and provide affected users’ notice before personal information is transferred or becomes subject to a different privacy policy.  We reserve the right to transfer or assign the information we have collected as part of such merger, acquisition, sale or other change in control and you consent to the transfer of your personal information in such circumstances.

How long will we keep your personal information?

We retain your personal information for as long as necessary to fulfil the purposes for which we collected it unless a longer period is required or permitted by law. 

If you tell us that you do not wish to receive marketing communications, we will keep this information about you until you tell us otherwise.  This is to ensure that we do not send you any further marketing communications in error.

Accessing and correcting your personal information

We will give you access to or correct your personal information unless there is a lawful reason for refusing your request.  If we deny access, we will provide you with the reason for such denial.  We may reject requests that are unreasonably repetitive, require disproportionate technical effort, risk the security of our products or services or the privacy of others, or are otherwise impracticable.

In most cases, we can provide you with a summary of your personal information free of charge. However, in some circumstances, we may recover from you our reasonable costs of supplying you with access to your personal information, subject to the Privacy Act and any other relevant laws.
